These Terms & Conditions apply to all mechanical servicing, repairs, maintenance, inspections, diagnostics and field service work performed by Ongmac Trading Pty Ltd (“Ongmac”, “we”, “our”, or “us”).
By requesting or authorising repair, maintenance or inspection work, the customer agrees to these Terms & Conditions.
Written quotations are valid for 30 days unless otherwise stated, Estimates are provided in good faith and are based on the information available at the time, Additional repairs discovered during servicing may require further authorisation before work proceeds, Prices may vary if additional faults are identified after dismantling or diagnosis.
Labour is charged at the current workshop hourly rate.
Charges apply for: Repairs, Servicing, Diagnostics, Electrical fault finding, Cleaning where excessive contamination exists, Assembly and disassembly, Testing and commissioning.
Labour is charged in minimum billing increments determined by Ongmac.
Field service charges may include: Technician labour, Travel time, Vehicle charges, Fuel, Accommodation, Meals, Toll charges, Ferry charges, Freight, Crane hire, Special lifting equipment, Waiting time caused by customer delays.
Minimum call-out fees apply.
FIELD SERVICE SAFETY CONDITIONS
To ensure the safety of our technicians, customers and the public, the customer agrees to provide: Safe unrestricted access, Stable ground conditions, Adequate lighting where required, Safe parking for service vehicles, Suitable lifting equipment where necessary, Machinery isolated before work commences, Animals restrained, Safe work environment, Access free from aggressive persons or unsafe behaviour.
If our technician believes conditions are unsafe, work will cease immediately.
Call-out, travel and labour charges incurred remain payable.
BIOSECURITY
Customers must advise Ongmac before arrival if machinery has been exposed to: Fire ant management zones, Weed infestations, Livestock diseases, Chemical contamination, Biological hazards, Sewerage contamination, Asbestos, Hazardous waste.
Cleaning or decontamination charges may apply.
The customer must ensure: Safe and unrestricted access to equipment, Machinery is located in a safe working environment, Suitable lifting equipment is available where required, Animals are restrained, Hazards have been disclosed prior to arrival, Equipment is clean enough to safely work on.
If work cannot safely proceed, Ongmac reserves the right to leave site and charge all applicable call-out and travel costs.
Equipment presented with excessive mud, concrete, grease, chemical contamination, crop residue or other contaminants may incur additional cleaning charges before repairs commence.
Diagnostic work is chargeable regardless of whether repairs proceed.
This includes: Electronic diagnostics, Hydraulic testing, Electrical testing, Compression testing, Fault finding, Software updates, Calibration.
Diagnosis does not guarantee that all faults will be identified during the initial inspection.
Parts supplied remain the property of Ongmac until paid for in full.
Special order or non-stock parts: cannot be returned for refund/credit, may attract a cancellation fee, require full payment prior to ordering.
Electrical components and electronic control units are generally non-returnable.
Where customer-supplied parts are fitted:
Ongmac accepts no responsibility for part quality or suitability, Labour remains fully chargeable, No warranty applies to failures caused by customer-supplied parts, Additional labour required due to incorrect or defective parts will be charged.
All repairs and replacement parts supplied by Ongmac Trading Pty Ltd are subject to the terms and conditions of the applicable manufacturer and the Australian Consumer Law.
Warranty Assessment
The customer acknowledges and agrees that: No warranty claim is accepted, approved or admitted at the time it is reported, All warranty claims must first be assessed by Ongmac Trading Pty Ltd and, where applicable, the original equipment manufacturer or component supplier, Warranty approval is solely at the discretion of the manufacturer where the part or repair is covered by a manufacturer’s warranty, Ongmac Trading Pty Ltd cannot authorise or guarantee a manufacturer’s warranty claim before that assessment has been completed, Any comments made by Ongmac employees regarding a potential warranty claim are preliminary only and do not constitute an admission or approval of warranty.
Before any warranty decision can be made:
The equipment must be made available to Ongmac Trading Pty Ltd for inspection unless otherwise agreed in writing, Ongmac may require the machine, component or failed part to be returned to our workshop for assessment, Ongmac reserves the right to dismantle equipment where reasonably necessary to determine the cause of failure, Failed parts may be retained and forwarded to the manufacturer or supplier for technical analysis, Warranty assessment may require photographs, service records, machine history, oil samples, diagnostic reports or other supporting information.
Unless expressly authorised in writing by Ongmac Trading Pty Ltd:
Repairs undertaken by another repairer may affect or void warranty eligibility, Ongmac will not reimburse labour, freight, accommodation, travel or parts supplied by third parties without prior written approval, The customer remains responsible for all repair costs until a warranty claim has been assessed and approved.
Warranty does not apply to failures resulting from, including but not limited to:
Normal wear and tear, Consumable or service items, Lack of routine maintenance, Failure to follow manufacturer operating instructions, Abuse, misuse or negligence, Overloading or operating outside the manufacturer’s specifications, Accident, collision, fire, flood, storm or environmental damage, Contamination from water, dirt, fuel, chemicals or foreign materials, Unauthorised modifications or alterations, Customer-supplied parts or accessories, Repairs carried out by persons not authorised by Ongmac, Continued operation after a fault becomes apparent, Damage resulting from failure to cease operation following warning lights, alarms or abnormal machine operation.
To the maximum extent permitted by law, Ongmac Trading Pty Ltd accepts no liability for consequential or indirect losses arising from equipment failure or warranty claims, including but not limited to:
Loss of income, Loss of production, Crop or livestock losses, Hire equipment costs, Transport costs, Accommodation expenses, Contract penalties, Loss of business opportunities, Downtime.
Australian Consumer Law
Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies that cannot be excluded under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.
Where a warranty claim is accepted, Ongmac Trading Pty Ltd’s obligations will be fulfilled in accordance with the manufacturer’s warranty policy (where applicable) and the requirements of the Australian Consumer Law.
Repairs are warranted in accordance with Australian Consumer Law.
Unless otherwise stated: Labour warranty applies only to work performed by Ongmac, Manufacturer warranty applies to genuine replacement parts, Warranty excludes normal wear and tear, Warranty excludes misuse, abuse, neglect, overloading or improper operation, Warranty becomes void if repairs are altered by another party.
Warranty claims must be returned to Ongmac for inspection before any repairs are authorised elsewhere.
Field repairs are intended to minimise equipment downtime.
The customer acknowledges: Field conditions may prevent repairs from being completed to workshop standards, Temporary repairs may be recommended, Further workshop repairs may be necessary.
Completion times are estimates only.
Ongmac is not liable for delays caused by: Parts availability, Freight delays, Weather, Supplier shortages, Industrial action, Equipment condition, Circumstances beyond our reasonable control.
Equipment not collected within 7 days of notification that repairs are complete may incur storage charges.
Equipment remaining uncollected after reasonable attempts to contact the owner may be dealt with in accordance with applicable legislation to recover unpaid costs.
Unless otherwise agreed:
Payment is due upon completion of work, Commercial accounts are subject to approved trading terms, Deposits may be required before work commences, Progress payments may be requested for major repairs.
Late payments may incur debt recovery costs, legal expenses and interest where permitted by law.
If repairs are cancelled after work has commenced, the customer remains liable for: Labour completed, Diagnostics, Parts ordered, Freight, Any subcontractor costs incurred.
To the extent permitted by law, Ongmac is not liable for: Loss of production, Loss of income, Hire costs, Consequential loss, Crop loss, Livestock loss, Downtime, Contract penalties.
Liability is limited to the repair or replacement of defective workmanship where required under Australian Consumer Law.
Our technicians may refuse to commence or continue work where: Conditions are unsafe, Appropriate PPE cannot be used, Machinery presents unacceptable risk, Weather conditions create unsafe work practices.
Charges incurred up to that point remain payable.
Waste oil, filters, batteries and other controlled waste will be disposed of in accordance with environmental regulations.
Old parts replaced during repairs may be retained by Ongmac unless the customer requests their return before repairs commence.
Ongmac may photograph machinery before, during and after repairs for warranty, training, quality assurance and service record purposes.
Customer information is handled in accordance with applicable Australian privacy legislation and is used only for providing products, services and customer support.
Nothing within these Terms & Conditions excludes, restricts or modifies any rights or remedies available to consumers under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.
